GE.26-04545 (E) 100426 100426 Human Rights Committee Decision adopted by the Committee under the Optional Protocol, concerning communication No. 4294/2023*, ** Communication submitted by: S.R. (represented by counsel) Alleged victim: The author State Party: Morocco Date of communication: 17 January 2023 (initial submission) Substantive issue: Extradition to the United States of America 1. The author of the communication is S.R., a national of France, born in 2001. At the time of the submission of the communication, the author was incarcerated in Morocco as part of extradition proceedings initiated by the Government of the United States. The author claimed that by extraditing him to the United States of America, the State Party would violate his rights under articles 7 and 14 (3) (b) of the Covenant. 2. On 31 January 2023, the communication was registered and, pursuant to rule 94 of its rules of procedure, the Committee, acting through its Special Rapporteurs on new communications and interim measures, requested the State Party to refrain from removing the author to the United States while his case was pending before the Committee, as it was unaware that the extradition had taken place on 25 January 2023. On 9 February 2023, the State Party informed the Committee that the extradition had taken place prior to the Committee’s request for interim measures. 3. On 13 October 2023 and 16 February 2024, the State Party submitted its observations on the admissibility and the merits of the communication. On 9 April 2025, the State Party’s observations were transmitted to the author’s counsel for comments. 4. On 16 June 2025, a reminder was sent to the author’s counsel to submit his comments on the State Party’s observations by 18 August 2025. Counsel was informed that, in the absence of a response, the communication might be discontinued. 5. On 16 March 2026, the Committee, in the light of the fact that it had received no response from the author, with whom it had apparently lost contact, decided to discontinue its consideration of communication No. 4294/2023.
